Our privacy policy, website terms, service terms and cookie policy for Market Partner Media Pty Ltd, trading as HospoPro.
We are not liable for any delay or failure to perform caused by events beyond our reasonable control, including outages, platform changes, natural events, illness, or acts of third parties.
We may update these terms and policies from time to time. The current version is the one published on this page, with its date at the top. For clients, we will email you before a change that affects your services takes effect, and you can cancel before it does. Continuing with the services after that means you accept the change.
We may send notices about these terms or your services to the email address you gave us. You can send notices to hello@hospopro.com.au.
These terms are governed by the laws of Queensland, Australia, and the courts of Queensland have jurisdiction. Before starting proceedings, the parties will attempt in good faith to resolve any dispute, including through mediation where appropriate.
If any part of these terms is found to be unenforceable, the rest continues to apply. Together with your plan or proposal, these terms form the entire agreement between us and replace any earlier understanding on the same subject.
This Privacy Policy explains how Market Partner Media Pty Ltd (ABN 34 630 522 548), trading as HospoPro (“we”, “us” and “our”), collects and handles personal information. We handle personal information in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles.
Depending on how you interact with us, we may collect:
We collect most personal information directly from you, including through our website forms, email, telephone calls and messages. Some information is collected automatically through cookies and similar technologies when you use our website (see our Cookie Policy). We may also receive information from platforms such as Facebook, Instagram or Google when you contact us through them. You may browse our website without identifying yourself; however, we require your contact details to respond to you or to provide our services.
We may use personal information to:
We do not use information from a form you did not complete to send you marketing emails unless you later complete a form or otherwise consent to receiving them.
We do not sell personal information. We disclose personal information only to service providers who assist us to operate our business, including advertising and analytics providers such as Meta and Google, and email and hosting providers. These service providers are required to protect personal information and to use it only to provide services to us.
Our service providers include our customer relationship and email platform (Brevo), our website host (Netlify), our call booking provider (Cal.com), Meta and Google, and contractors who work on client accounts under obligations of confidentiality. We may also disclose personal information where required or authorised by law.
When we provide marketing services to a venue, we may handle personal information about that venue’s customers, such as an email list used for a campaign. We use that information only to provide our services, in accordance with the venue’s instructions, and we keep it confidential. The venue remains responsible for ensuring that the information was collected lawfully (see our Service Terms).
We retain personal information only for as long as it is required for the purposes described in this Privacy Policy, or as required by law. Information from a form you did not complete is retained only for as long as is reasonably necessary to follow up on the enquiry or request you started and to maintain accurate business records. You may ask us to delete your personal information at any time.
You may request access to the personal information we hold about you, and you may ask us to correct or delete it. To make a request, please email hello@hospopro.com.au. We will respond within a reasonable period.
If you believe we have mishandled your personal information, please email hello@hospopro.com.au with details of your complaint. We will investigate the matter and aim to respond within 30 days. If you are not satisfied with our response, you may lodge a complaint with the Office of the Australian Information Commissioner at oaic.gov.au.
Some of our service providers, including advertising, analytics, email and cloud hosting providers, may store or process personal information outside Australia. Where we disclose personal information overseas, we take reasonable steps to ensure that it is handled in a manner consistent with the Australian Privacy Principles.
We may send you marketing communications about our services. You may opt out at any time by using the unsubscribe link in any email or by contacting us.
We take reasonable steps to protect personal information from misuse, interference, loss and unauthorised access, modification or disclosure. No system is completely secure, and we cannot guarantee absolute security. If an eligible data breach occurs, we will notify affected individuals and the Office of the Australian Information Commissioner as required by law.
Our services are directed to businesses and are not intended for individuals under 16 years of age. We do not knowingly collect personal information from children.
By accessing this website you agree to these terms. If you do not agree, please do not use the site.
This website and its content are provided on an “as is” and “as available” basis. To the maximum extent permitted by law, we make no warranties, express or implied, about the site’s accuracy, completeness, reliability or availability, and we do not warrant that it will be uninterrupted or error free.
Content is provided for general information and marketing purposes only. Case studies, figures, examples and pricing may change without notice and do not form an offer or a promise of any particular outcome. You should not rely on site content as professional advice.
All content on this site, including text, graphics, logos, layout, code, branding and the HospoPro name, is owned by or licensed to us and is protected by intellectual property laws. You may not copy, reproduce, republish, scrape, or create derivative works from it without our written permission.
You agree not to misuse the site, including by attempting to gain unauthorised access, interfering with its operation, introducing malicious code, scraping data, or using it for any unlawful purpose.
Prices on this site are in Australian dollars and exclude GST unless we say otherwise. GST is added where it applies. If a price or offer is shown in error, we may correct it before you sign up, and we are not bound by an obvious mistake.
Our free offers, such as the Venue Score, Menu Score, free Studio Shots, the first month offer and the free website, are for hospitality businesses in Australia. Each offer page sets out its own conditions, and those conditions form part of these terms and prevail if they differ. Unless an offer page says otherwise, offers are limited to one per venue, have no cash value, cannot be transferred, and may be changed or ended at any time. We may decline a request, for example if it is not from a genuine hospitality business. A free offer does not commit you to a paid plan. Starting a form, or entering information into it without submitting it, does not make a request, claim an offer or a place in one, or create any agreement between you and us. A request or claim is made only when you submit the completed form and it is accepted.
When you upload or send us menus, photos or other files, you confirm you have the right to share them, and you let us use them to provide what you asked for. You also give us a non-exclusive, royalty-free licence to show those files, and the work we make from them (such as before and after shots or a Menu Score), in any of our marketing, including our portfolio, website, social media, ads, billboards, print and case studies, along with your venue’s name. If you would rather we did not, email hello@hospopro.com.au and we will stop using them in new marketing and take down what we reasonably can.
The site may link to third-party websites. We do not control and are not responsible for their content, privacy practices or availability. Links do not imply endorsement.
These terms apply to the marketing services we provide. The specific scope, plan and price are set out in the plan or proposal you sign up to, which forms part of your agreement with us.
If you are not happy within your first 28 days, you may request a full refund of that first period. The guarantee applies to our service fee, not to advertising spend already paid to third-party platforms, which is non-refundable once spent.
To do our job we rely on you. You agree that:
We send content to you to approve before it runs. Once you approve it, or if you have switched on auto-approve, you accept that content as suitable to publish for your venue, and you are responsible for checking that offers, prices, opening hours and other facts in it are right. Tell us straight away if something needs to change or come down, and we will act on it as soon as we reasonably can.
Your social media, advertising, website and email accounts stay in your name and under your control. You give us the access we need, and you can remove it at any time. We are not responsible for changes made in those accounts by you, your staff or anyone else you give access to.
If we send email or text campaigns to your customers on your behalf, you confirm that everyone on your list has agreed to hear from you as required by the Spam Act 2003, and that you collected their details in line with privacy law. Campaigns go out in your venue’s name, and you remain responsible for the list.
Some services, such as digital billboards, depend on space owned by others. They are subject to availability, and we cannot guarantee a particular placement, location or time. Ad spend included in a plan is used for your campaigns, has no cash value and cannot be refunded or paid out.
We may use trusted contractors and partners (for example, partner teams who build websites) and software tools, including AI tools, to deliver the services. We remain responsible for the work they do for you, and they are bound by confidentiality.
We may change our plan prices. If you are a client, we will tell you by email before a new price applies to you, and because plans are month to month you can cancel before it does.
You keep ownership of the final deliverables we create for you: photos, posts, pages, followers and ad accounts remain yours. We retain ownership of our pre-existing materials, tools, templates, processes, know-how and systems, and of anything we develop generally in running our business. We grant you a licence to use those elements only as part of the deliverables. Until we are paid in full for a deliverable, any licence in it is conditional on that payment.
Our services depend on platforms we do not control, such as Meta, Google, Instagram and email providers. We are not responsible for their policies, outages, algorithm or pricing changes, account reviews, suspensions or removals, or for any loss caused by them. You are responsible for complying with each platform’s terms.
Each party will keep the other’s confidential information private and use it only to perform the agreement, except where disclosure is required by law.
Either party may end the engagement with reasonable notice. We may suspend or end services immediately if you breach these terms, fail to pay, or ask us to do something unlawful. On termination, fees for work already done remain payable. When you leave, you keep your accounts, followers, posts, photos and pages, and we will hand over access to anything we hold for you within a reasonable time, once your account is paid up.
Marketing outcomes vary and cannot be guaranteed. Except for our express 28-day satisfaction guarantee, we do not promise any specific result, including revenue, bookings, covers, followers, reach, ranking or return on investment. Examples and case studies show what has been possible for others, not what you will achieve.
Results depend on many factors outside our control, including your venue, market, pricing, staff, service, offer, budget and the third-party platforms we use. You accept that any forecast or estimate is an opinion, not a commitment.
Nothing in these terms excludes, restricts or modifies any right or remedy you have under the Australian Consumer Law (ACL) that cannot lawfully be excluded. This section applies subject to those rights.
To the maximum extent permitted by law:
Advertising budgets are charged directly by third-party platforms such as Meta and Google. You set and authorise your ad budget, and that spend is a matter between you and the platform. To the maximum extent permitted by law, we are not liable for advertising spend or any charge levied by a platform, including budget overruns, overspend, duplicate or unexpected charges, currency differences, or charges caused by platform errors, outages, account settings, fraud or changes to the platform. We will take reasonable care in managing campaigns, but we do not guarantee spend will exactly match a stated budget and we are not responsible for making up any difference.
You agree to indemnify and hold us (and our directors, staff and contractors) harmless from any claim, loss, liability, cost or expense (including reasonable legal costs) arising out of or in connection with: content or materials you provide to us; your use of the deliverables; your products, services, venue or offers; your breach of these terms; or your breach of any law or third-party right. Your indemnity is reduced to the extent the claim, loss or cost was caused by our own negligence or breach of these terms.
We want to be upfront about how images on this site and in our marketing are made.
Some imagery is AI-generated or AI-enhanced. Certain photos, portraits, venues, dishes and mockups shown on this website are created or enhanced using artificial intelligence and are used to illustrate the style and quality of work we produce. They may not depict real people, venues, dishes or events, and any resemblance to a real person or place is coincidental.
Photography and content we deliver as part of a paid engagement is produced from your real venue, dishes and brand. Where we use AI tools to retouch, upscale, generate or enhance client images, we do so to improve quality. Before you publish, check that Studio Shots and other enhanced images fairly show the dish, drink or venue a customer will actually get, so they are not misleading. You are responsible for how you use delivered content, including any disclosure your industry or platform requires for AI-assisted media.
Any testimonials, names, venues or results we publish are from real clients and shared with their permission. Results shown are examples of what has been achieved and are not a promise of the same outcome for you.
Unless you tell us otherwise in writing, you grant us a non-exclusive, royalty-free licence to display work we created for you (including photos, campaigns, results and your business name and logo) in our portfolio, case studies, website and marketing. You can withdraw this permission for future use at any time by emailing us. Any testimonial we publish will be one you actually gave us.
If you give us a review or testimonial, in any form, you agree we can share it. That includes a review on Google, Facebook or any other review site, a message or email, a survey answer, or a video, photo or voice recording. By giving it to us, you grant us a free, non-exclusive, worldwide and ongoing licence to use it in any of our marketing, in any format or medium, including:
We may shorten, crop, caption, subtitle or translate it, or use a short excerpt, but we will not change what you meant or present it in a way that is misleading. We will only use it as the law allows, including the Australian Consumer Law rules on genuine testimonials, and the terms of the platform it was posted on. If we gave you anything in return for a review, we will say so where the law requires it.
You can ask us to stop at any time by emailing hello@hospopro.com.au. We will stop using it in new material and take it down from our website, social media and live ads within a reasonable time. We cannot recall material already printed, sent or shared by others.
Every email from HospoPro ends with a short confidentiality note and a link to this section. This is what that note means, in full.
Our emails, and any files attached to them, are meant only for the people they are addressed to. They may contain confidential or commercially sensitive information, such as pricing, campaign plans, results or details about your venue. Sending an email to the wrong person by mistake does not make its contents public, and does not waive any confidentiality or legal privilege that applies to it.
We take care with what we send, but email is not a secure or guaranteed way to communicate. A message can be intercepted, changed, corrupted, lost, delayed or arrive incomplete, and it can carry viruses. To the extent the law allows, we do not accept liability for errors or omissions in an email, or for loss or damage caused by a problem in its transmission. Please check attachments with up to date antivirus software before you open them.
Please do not send passwords, full card numbers or other highly sensitive information by email. If we need access to an account, such as your Meta or Google ad accounts, we will ask you to grant access through that platform instead.
Scammers sometimes copy a business’s emails to send fake invoices or new bank details. If an email that looks like it is from us asks you to pay into different bank details, or to pay in an unusual way, check with us first using contact details you already know, not the ones in that email. We are not responsible for payments made on the strength of an email we did not send.
An email from our team is not a binding agreement or a change to our Service Terms unless it says so clearly and is confirmed in writing by an authorised person at HospoPro. Opinions in an email are those of the person who wrote it.
We only send marketing emails as allowed by the Spam Act 2003. Every marketing email shows who it is from and has an unsubscribe link, and we act on unsubscribe requests within five business days. Emails about the work we are doing for you are part of the service, so they keep coming while you are a client.
Emails you send us, and the details in them, are handled under our Privacy Policy above.
Questions about privacy, these terms or our imagery? We are happy to help.
